The range of UK immigration services
available to people wishing to immigrate to Britain is
broad and varied, encompassing economic based routes such
as UK
work permits, and the Highly
Skilled Migrant
Programme or HSMP,
as well as family immigration visas and visitor visas
designed for those wishing to visit Britain for a short
period.
At CIN our immigration consultants can offer expert advice
on every class of UK immigration service and can provide
a comprehensive package of services to suit your needs,
from initial advice on making a UK visa application through
to on arrival services to help you adapt to living and
working in Britain.
Economic migration is a key component of the British economy
allowing skilled migrants to bring desirable skills and
experience to the domestic workforce. The Highly Skilled
Migrant Program is a points based visa service specifically
designed to attract the most gifted individuals to the
United Kingdom. In addition applying for a UK
work permit, allows a British company to sponsor an
overseas worker to come to Britain and contribute to the
British economy by bringing their skills to the domestic
workforce.
Business based British visas take a variety of forms and
CIN can help people to gain UK entry clearance and to
apply for business immigration through several routes.
The Entrepreneur visa allows experienced business people
to live and work in Great Britain, investing capital and
starting a business within the United Kingdom. Alternatively,
applicants may come to Britain on a self-employed visa,
with a pioneering idea under an innovator visa or simply
to invest in the British economy through an Investor visa.
British visa applications under all of these routes offer
the potential to apply for Indefinite leave to remain
in the UK (ILR) or permanent residency as it is often
known. We can help applicants to switch when appropriate
from one route to another and can manage applications
for permanent residence and later British naturalization
as a UK citizen.
As well as business based applications for visas for Britain,
we can also help you to obtain any of the range of visas
for UK immigration, which allow people to train or study
in Britain, and to experience life in the United Kingdom.
A study permit, or student visa application, allows international
students to study in the UK experiencing the culture and
environment of the United Kingdom whilst at University.
Beyond a study visa for the UK, schemes such as the Science
and Engineering Scheme (SEGS), soon to be re-launched
as the International Graduate Scheme, and the Fresh Talent:
Working in Scotland programme allow students to experience
working in the UK for a limited time.
We can also help candidates to take advantage of the Training
and Work Experience Scheme or (TWES) allowing overseas
naturals to undertake work experience or training in Britain,
or to participate in the Working Holiday scheme which
allows a combination of both visiting and working in Britain.
While CIN specialises in assisting talented individuals
to live and work in the UK or to benefit from the range
of experience and training opportunities available, assistance
can also be provided for other British immigration services.
We can secure partner and relationship immigration visas
for people with British connections who wish to settle
in the United Kingdom by means of a UK
Marriage visa, UK
Fiance visa or De
Facto visa, often known as an unmarried partner visa.
In addition, we can help tourists and business visitors
to gain entry clearance through a temporary UK
visit visa, frequently referred to as a travel visa
or tourist visa. |

| HSMP |
| Highly
Skilled Migrant Programme: |
Description:
A Highly Skilled Migrant Programme visa application for
the UK, usually referred to as HSMP, is an option for
immigration to the United Kingdom available to professional
people, or to those who are interested in working in the
UK without requiring a Work Permit.
Benefits: The Program operates on a points-based
system and allows people with valuable professional skills
to migrate to the United Kingdom in order to look for
work or to become self-employed. Unlike a UK Work Permit
the HSMP UK visa service requires neither an application
from a British company nor a specific offer of employment
to be in place. As a result, HSMP offers greater flexibility
to the holder ensuring that they are not tied to an employer
and are free to undertake employment as they choose.
In addition, HSMP differs from the Innovators scheme or
other business categories in that applicants do not need
to invest, create jobs or present a detailed business
plan. After five years, UK HSMP visa holders can apply
for British naturalization, or British Citizenship, for
permanent residency in the United Kingdom.
Duration: Initially a visa for Britain
through HSMP is granted for a period of two years. After
the initial two years, migrants with desirable skills
need to apply to stay longer and must show that they are
economically active. If you are active through our limited
company option (see below), you will earn more points
than if you were employed directly. However, either situation
is acceptable provided that you can demonstrate evidence
of employment. Eligibility Criteria
:
The points system requires applicants to obtain a minimum
of 75 points based on the following criteria: -
Age. - Educational
Qualifications. -
Previous Earnings. -
Work Experience in Britain. Age
While age is not a precluding factor for HSMP immigration,
people of certain ages receive more or less points according
to the following scale: -
27 or under = 20 points. -
28-29 = 10 points. -
30-31 = 5 points. -
32 and over = 0 points. Education
Points are awarded in this area of the British
HSMP based on the level of qualifications achieved. A
British equivalent degree is the minimum qualification
required for Highly Skilled Migrant Programme visas. The
HSMP point calculator awards additional priority points
to Doctors who are allowed to work as General Practitioners
in the United Kingdom. In summary
points are awarded as follows: -
PhD - 50 points. -
Masters Degree or Professional Level Qualification - 35
points. - Bachelors
Degree - 30 points.
(A British
qualification in any of the above categories will gain
an additional five points).
(An MBA
from a participating university received after December
2nd 2004 will automatically
reach the 75 point quota). Work Experience
Points in this area are calculated on the number of year's
experience gained by a candidate making an HSMP application
in their chosen field. Additional points can also be awarded
if the applicant has held a senior or specialist role
for a number of years. Past Earnings
Between 5 and 45 Points are awarded for earnings made
over the past 12 months. Where the earnings took place
is also taken into account, and working in the UK can
add an additional 5 points when your eligibility to pursue
UK immigration on this basis is considered. The
following additional requirements are also essential to
qualify for HSMP: -
Applicants must have a high level of ability in English.
- Applicants must
be able to support themselves without recourse to public
funding. - Applicants
who are or have ever been bankrupt are not eligible.
- Applicants who have
been convicted of a criminal offence at any time are not
eligible. - Applicants
must intend to make the British Isles their main home.
Self Employed Option: Our
Self employed option allows a person to earn more money
per year. As UK HSMP consultants, we set up and manage
a Limited company for you allowing you to earn several
thousands of pounds more take-home pay. We do this by
saving you from large tax bills while working in the country.
HSMP applications with the option of working as a freelancer
or contractor will not only allow for greater earnings
but will also receive more points towards an HSMP extension
visa. This means that when your initial two year visa
is due for renewal you will be awarded extra points for
working through our company solution. This will strengthen
your case and save you thousands of pounds in the process.
Please note that if you currently have a tax solution
in place or wish to work under PAYE this will not prevent
us from assisting you. Additional
Information
Spouse/Unmarried Partner
Successful UK visa applications of this kind allow the
spouse/unmarried partner of an HSMP holder to apply for
a Dependency
Visa In these circumstances, spouse immigration requires
that the dependant in question must cohabit with you.
Unmarried partners making applications for UK visas as
dependants must be able to demonstrate that their relationship
existed for at least two years prior to the application
for HSMP |

Entry Clearance |
Description:
Entry clearance is issued to all people who apply to UK
Visas for leave to enter the UK. Entry Clearance is issued
to all commonwealth and non visa nationals who wish to
remain in the UK for six months or more. Visa nationals
are required to apply to UK Visas for Leave to Enter the
UK regardless of the length of stay. A UK visa takes the
form of a vignette or sticker placed in a passport at
a UK visas issuing post overseas (normally a UK embassy
or consulate). Bio Metric Visas will require a person
attend the British Embassy for their Bio metrics to be
taken. The Visa specifies the purpose for which the holder
wants to enter the UK, as well as the conditions of the
visa. There are five distinctive types of leave to enter
issues by UK visas overseas.
Duration:
When UK entry clearance is granted, it will state a "valid
from" date and a "valid to" date. Depending
on the purpose of travel to the UK this will vary.
Eligibility Criteria
A person must be able to show they are conducive to the
public good and the UK economy. It is important they are
also able to prove their reason for applying for the visa
is valid and meets the UK Immigration law requirements.
In the case of HSMP or Work Permits a person must be able
to prove their qualifications meet the Immigration requirements.
If they are relying on previous experience and/or salary
to assist in their UK visas case they will have to provide
documentary evidence to confirm their claims. Often due
to the high number of forged documents that are easily
available in the modern world British Entry Clearance
Officers will run further local checks to make sure the
documents are genuine.
A person maybe required to attend an interview so the
Immigration Officer can determine if the person is respectable
but also to confirm any facts about the case that are
unclear. These interviews can take some time and an officer
is liable to ask many difficult questions. Their training
and experience allows them to make decisions on a case
based on their feeling about the person during the interview.
Visa Status
Work permit holders who are non EEA nationals (including
non-visa nationals) who wish to immigrate to the UK for
more than six months must obtain UK entry clearance before
travelling. HSMP and other working visas also allow people
to work while in the UK. While medical visitors and business
visitors are prevented from working in the UK. The status
of a Visa is determined by the reason for travel to the
UK. Processing Times
Processing times vary depending on the country in which
the person is applying. We have links with over 100 British
High Commissions and embassies across the Global and we
aim to minimise the amount of time our clients have to
wait for a British Visa.
We are able to reflect our client as a true upstanding
member of the community which our clients are. We present
cases that are pre vetted and stand the highest possible
chance of success. Our clients are also informed about
the procedure and what to expect if an interview is required.
If a case is refused locally we have the skills and experience
to appeal the case in court in the UK. This is vitally
important as the British Immigration people know we will
fight a case they have to be prepared to go to court if
they refuse our clients case.
The types of entry clearance cases we assist with cover
the following: HSMP Entry Clearance, Work Permit Entry
Clearance, Marriage entry clearance, Dependents Entry
Clearance, Student Entry Clearance, UK Ancestry Entry
Clearance and many more. |

Visit Visa |
Description:
A UK visit visa, also referred to as a travel or tourist
visa, accompanies your passport and allows you to enter
and stay in Britain for a period of up to six months.
The UK visiting visa service allows people to visit Britain
for medical treatment and assists those passing through
the country en route to other destinations. Benefits:
Visit visas can be valid for six months, or for more frequent
visitors, one year, two year, five year or ten year UK
tourist visas are available. During this period, you will
be allowed to enter and depart from the country any number
of times within the visitor visa's duration. However,
no single visit can last for a period of more than six
months. Occasionally the validity of visas for travel
to the UK may be limited to only one or two trips by an
Entry Clearance Officer (ECO). Eligibility:
To qualify for this type of British visa service you will
be required to demonstrate that you intend to visit the
country for no longer than six months and that you will
depart upon the expiry of the document. Visitor visas
also oblige you to show that you will be able to fully
support and accommodate yourself for the duration of your
stay in the British Isles without working and without
the assistance of public funding. Medical
Treatment: You can apply for a travel visa for
Britain if you wish to visit in order to receive private
medical treatment. In such circumstances, you must be
able to fulfill the following additional criteria:
- Arrangements for
consultation or treatment must already be in place before
UK visit visas are
pursued. -
The cost of the private treatment can be met in full.
Treatment on the NHS is not permitted.
In addition,
you may be asked to produce a Doctor's letter as part
of your visit visa application
detailing the condition and the appropriate treatment.
It may also be necessary to
attend an interview. Studying
in the United Kingdom: British visiting visas
allow you to study in Great Britain but you will still
be required to depart before or upon the expiry of six
months. If you intend to study for more than six months,
you will need to apply for a student visa.
Working in the United Kingdom:
Whilst in possession of your British visa you will be
permitted to carry out the following
business related activities:
- Attend conferences,
seminars or trade fairs in the capacity of a delegate
or to buy goods, negotiate
or complete contracts.
- Conduct research
or examine goods. -
Undertake training limited to observation or classroom
instruction.
Other
limited business circumstances under which you may enter
the country on a UK travel
visa include: -
Delivering goods from abroad.
- Representing a foreign
company to repair or install products, to advise, consult,
train or troubleshoot. -
To oversee or speak at a conference or seminar provided
that the contribution lasts no more than 5 days.
In all cases where a visit to Britain is based upon an
invitation from an indigenous Company, applications for
visit visas must be accompanied by written evidence of
the invitation and, where appropriate, confirmation that
either your own Company or the destination Company will
meet the cost of the trip.
What you cannot do: Applications for UK travel visas do
not allow holders to partake in the following: -
Employment, either paid or unpaid. -
Providing commercial services, producing or selling goods.
If your intention is to take up employment or to search
for work upon arrival, please visit our sections covering
work permit procedures and the Highly Skilled Migrant
Programme (HSMP). HSMP, subject to meeting the eligibility
criteria, allows for immigration to the United Kingdom
to seek employment. A work permit would require a specific
offer of employment from a British company. Entering
the country en route to another destination:
UK visiting visas may also be required if you intend to
visit Great Britain as part of a trip to another country.
If you are entering the United Kingdom in transit to another
destination and will not be departing again until a date
in excess of 48 hours you will need to apply for a UK
visitor visa for your trip. |

| Fiance
Visa UK - Prospective Marriage Visa |
Description:
The UK fiancé visa service allows a person to
bring their fiancé to join them in the United
Kingdom as long as they themselves have settled status
as a permanent resident or British citizen. Settled
status means that they are living here lawfully with
no time limit on their stay. If you are returning to
the United Kingdom to settle, your partner can also
apply for a UK fiance visa to join you at the same time.
If you wish to bring your spouse or common-law
partner to join you in the United Kingdom, Global visas
can help at every stage of the process. As a specialist
UK immigration consultancy, we can provide expert immigration
lawyer advice and help you embark upon the best route
for your needs. Our UK immigration consultants can assist
at all stages of a fiancee visa application, marriage
visa application, De facto visa or unmarried partner
visa application as well as the range of British work
permits and visas for immigration to Britain.
Benefits:
Fiance immigration to the UK through this type of visa
for Great Britain grants your partner leave to enter
the UK in order to marry. Unlike other spouse immigration
routes such as marriage visas, De facto visas and the
Highly skilled Migrant Programme, or HSMP, fiance visas
do not require applicants to provide evidence that a
relationship has already been in existence for a given
number of years.
Duration:
Fiancée visas are issued for a period of six
months and are awarded solely for the purpose of travelling
to Britain in order to get married. Only after marriage
may the applicant apply to stay in the country beyond
the six-month period, at which time a two-year UK visa
extension may be issued in the shape of a marriage visa.
After this time, a person can apply for Indefinite
Leave to Remain (ILR), often known as permanent
residency in the UK, as long as the marriage continues
to stand.
Eligibility Criteria:
Age:
People who wish to apply for this class of immigration
service must be 16 years of age or over, and the partner
with the settled status or who is returning to Britain
to live permanently, must be 18 years of age or over.
Relationships:
To qualify for a UK fiancée visa partners must:
1.
Plan to marry within a reasonable time (usually six
months).
2.
Plan to live together permanently after they are married.
3.
Have met each other.
4.
Have a place to reside for the applicant and any dependants
to live until they are married without
help from public funds.
5.
Be able to support any dependants without working or
receiving help from public funds.
Additional Information:
Only after an applicant's fiance-prospective marriage
visa is changed over to a two-year marriage visa are
they able to start working and hold the same rights
as their spouse who is present and settled in the United
Kingdom. However, once a two-year grant of leave has
been obtained, applicants will be able to work without
the need for a UK work permit and without restrictions
upon the type of work undertaken. Applicants for a visa
for Fiancee immigration should marry within the six
months from the date of issue.

Designated Area Sponsored Migration to Australia |
Description: Skilled Designated
Area Sponsored migration to Australia is based predominantly
on an applicant being sponsored by a relative who lives
in a designated area in Australia. There are also requirements
based on the sponsored work visa applicant's skills, qualifications
and work experience. The Skilled Designated Area sponsored
migration to Australia visa subclass has several criteria
for pre-qualifying applicants.
Duration: People emigrating
to Australia on this work visa will gain temporary residency
status in Australia for up to 3 years and may then qualify
for a permanent visa. Australian citizenship may be applied
for after a two year period providing relevant criteria
have been met. Eligibility Criteria
Age: The applicants must
be under 45 years of age to apply.
English Language: The applicants
must have sufficient English Language ability for working
in Australia.
Skills & Qualifications The main
applicant: Must have tertiary
qualifications (substantial relevant work experience may
be acceptable for some occupations), which
must have been assessed as suitable by the relevant assessing
authority for the applicant's nominated occupation;
Must nominate a skilled occupation that
appears on the most recent version of the Skilled Occupations
List;
Must have been in recent paid employment of
at least 20 hours per week in any of the occupations
on the Skilled Occupations as follows:
- If the nominated

applying.
Sponsorship: The applicant:

a niece or nephew or 1st cousin (step-relatives and
adoptive relatives are accepted in some cases). The
sponsor must be 18 years of age or over and be an Australian
citizen or permanent resident. In certain cases New
Zealand citizens may also act as the sponsor.
Assurance of Support: To
migrate to Australia under this visa category, the Australian
sponsored visa applicant (or spouse) must have an assurer.
An assurer must themselves meet several requirements,
details of which are open to change. A Global Visas
consultant will provide a complete overview of the sponsorship
and assurance requirements for Skilled Designated Area
Sponsored migration to Australia during an initial consultation.
Health & Character:
Australia has strict health and character requirements
that must be met before any permanent Australian visa
of more than 12 months will be granted. People attempting
to migrate to Australia under the Designated Area Sponsored
visa category will be required to:
- Undergo a medical
examination and chest X-ray undertaken by one of a panel
of doctors selected
by the Australian authorities, and;
- Obtain police
certificates for all countries in which they have lived
for more than 12 months in
the 10 years leading up to the application.
Processing Times: The current
processing time for skilled designated area sponsored
migration to Australia is 10 - 12 months
from the start of the process. A Global Visas consultant
will be able to advise you of the latest processing
times.
If you think you meet all of the basic requirements,
the next step is to find the right visa for you. This
will depend on your circumstances. If you already know
which General Skilled Migration visa you wish to apply
for, detailed information on the requirements for each
visa is available.
You must provide 'certified copies' of original documents,
with the exception of your police clearance/s. 'Certified
copies' means copies authorised, or stamped as being
true copies of originals, by a person or agency recognised
by the law of your home country.
Documents in languages other than English must be accompanied
by an English translation completed by a translator
accredited by the National Accreditation Authority for
Translators and Interpreters (NAATI) or by a translation
service that has been approved by the relevant government
authority in your country.
During the processing of your application, you and all
your family unit members included in your application
will need to confirm your/their identity. This is usually
done by checking a current valid passport. The passport
you use should be the one you intend to use to travel
to Australia if a visa is granted. This passport should
be valid for at least two years. You should use this
passport to provide evidence of your identity in connection
with any aspect of your General Skilled Migration application.
In particular, you will need to present your passport,
as will all members of your family unit, to the doctor
when you have your health examination.
When you lodge your application, it is important that
you include all the documents necessary to assess your
application. Lodging a complete application assists
case officers to quickly assess your claims and facilitates
faster processing. Document checklists are available
for each General Skilled Migration visa to assist you
in lodging a complete paper application. The checklists
detail all the supporting documentation you are required
to lodge with your application and explain how these
documents should be ordered and numbered within your
application. It is essential that you apply using the
correct application forms and application checklists.
The above description is a summary of what is involved
in a successful immigration application. There are several
other steps involved in the immigration process. Remember,
immigration processing is not as simple as it seems.
One wrong step can destroy your dreams of immigrating.
So, if you want a hassle free process, contact us with
details of your circumstances and a CV for advise.
A registered migration agent can provide you with information
or advice concerning immigration matters. You can find
a registered migration agent on the website of MARA.
If you are in Australia and seeking immigration assistance
you should only use a registered migration agent.
HSMP is currently the only points-based immigration
route into the UK. The change in assessment criteria
reflects our determination to ensure greater transparency
and objectivity in decision making for the applicant.
Importantly too, these changes will inform the decisions
Government will take towards establishing the new five-tiered
Points Based System for all migration routes to the
UK to work or study by April 2009.
In summary:
New points criteria for initial HSMP applications:
There will be changes to the attributes for which points
are awarded. Home Office are deleting the work experience,
significant achievements, skilled partner and GP Priority
Provision categories. The new attributes will be academic
qualifications, previous earnings, age and bonus points
for previous work/study in the UK. The provision which
allows holders of MBA degrees from designated institutions
will continue. In addition, there will be a new mandatory
English language requirement (IELTS level 6 or equivalent)
for all applicants.
The changes will be made by announcing the deletion
of the existing HSMP rules on 7 November 2006, effective
from 8 November 2006. As part of this announcement,
to prepare applicants and ensure an effective operational
transition, Home Office will effect a short suspension
of the scheme until 4 December 2006. The revised scheme
will be operational from 5 December 2006.
Suspending the HSMP for 27 days will enable us to manage
the transition most effectively with the available resources
and ensure that current levels of customer service are
maintained when the new arrangements are introduced.
New criteria for the extension of leave under
HSMP
Home Office will introduce a more robust points test
for applicants looking for an extension of an initial
period of leave under HSMP. This involves replacing
the current test, that applicants must show that they
have 'taken all reasonable steps to become lawfully
economically active' with a new points test, which applies
the same attributes being introduced for initial decisions:
English language, previous earnings, qualifications
and age.
The revised Leave to Remain criteria will ensure that
those people on the programme who wish to extend their
stay have been making a contribution to the UK economy.
Transitional arrangements will apply for those whose
leave to remain expires under the new rules and whose
applications will be considered against the new criteria.
Those who are making a useful contribution to the UK
economy - for example, working in a skilled job - but
who fail to meet the new requirements, will be offered
a 'grace period' in which they can switch into the Work
Permits scheme (provided they meet the Work Permits
criteria, with the Resident Labour Market Test being
waived if they have been in post for a specified period).
HSMP Review requests
Any HSMP review request received from individuals whose
application was refused under the previous HSMP criteria,
in place until 7 November 2006, will be reviewed against
the previous criteria. Please note these reviews may
not have been completed by 5 December 2006 when the
new HSMP criteria come into effect.
New mandatory English requirement and documentation
verification
Home Office will promote the new mandatory English
language requirement to ensure that applicants are aware
of the level of proficiency necessary to support a successful
application.
Home Office will promote the change to the scheme which
puts responsibility on the applicant to submit the required
documentation with their application. Home Office will
verify evidence provided with an appropriate third party
and not through direct contact with the applicant. Home
Office will confirm that applicants that don?t provide
the required evidence or submit documents that cannot
be verified will fail.
IND will conduct a thorough review of the changes to
the HSMP scheme, covering both how the changes Home
Office implemented and their effectiveness.
What has changed?
In addition to the minimum required points being raised
from 65 to 75 there have been changes to the points
categories; work experience, significant achievements,
skilled partner and GP priority categories have all
been removed. New attributes will be academic qualifications,
previous earnings, age and bonus points for previous
work and study in the UK.
The MBA provision for HSMP which allows holders of MBA
provisions from designated institutions will remain.
There will also be a mandatory English language requirement.
